Our terms and conditions are straight forward and to the point. There is nothing hidden in the text and there are no additional fees added on at a later date.
· The following terms and conditions cover any agreement between, Anaconda Debt Recovery (for the terms of this agreement will be referred to as “The company”) and any party that enters into a contract with the company shall be deemed the customer.
· Upon signing of an agreement between the company and the customer, the customer gives permission to the company to pursue any outstanding debt on their behalf using whatever means necessary within current legal guidelines.
· Once an agreement has been signed by both parties and the appropriate payment made the company will provide debt recovery services to the customer for a period of 120 days. Unless otherwise agreed.
· The customer may provide details of multiple debts up to a pre-agreed maximum number
· We may, if deemed necessary, provide a face to face visit to the debtors premises in order to secure payment. There will be an additional charge for this service. Unless otherwise agreed.
· The debt recovery service shall commence from the day the agreement is signed. If at the conclusion of the contracted period (120 days*), there have been no monies recovered, then the contract has expired. At this point the company and customer may discuss alternative methods of recovery
· *If the debtor is unable to clear the debt in full then the company may provide monthly payment terms to the debtor. In this case the initial agreement may be extended in order to incorporate the payment terms.
· If a debtor is unable to provide full payment of a debt, we will provide a repayment facility no longer than a maximum of twelve months in total whereby a fixed amount will be paid every month until the full debt value has been cleared. Any payments applicable to the company will be deducted accordingly and the remainder will be released to the customer after 30 days. Where a debtor defaults on a payment plan the company will endeavour to recover the balance of monies due.
· Following recovery of a lump sum payment the appropriate percentage shall be retained by the company and the balance will be transferred within 30 days from the date of receipt.
· The company is not contractually obliged to provide written updates in relation to cases, but will provide best endeavours to give either an email or telephone update where possible.
· The company cannot be held liable for any incorrect information provided by the customer that may delay recovery of the debt or if the debtor enters into a bankruptcy agreement, Liquidation or receivership or any other insolvency proceedings. Also if we have to pause operations due to covid restrictions.
· If following the signing of an agreement between the company and the customer, a direct payment is made to the customer by the debtor then the customer must notify the company immediately and the appropriate fees must be paid by the customer as per the agreement terms.
· The appropriate charges will be made upon signing an agreement. The specific charge will be agreed with each client and a retention fee will be applicable. This fee will be agreed in advance with the client dependant on the debt value.
· Additional recovery fees will be charged to the debtor. These fees are only applicable to the debtor. If in the event these fees are not fully recovered, there will be no liability on behalf of the customer to cover these additional costs.
· The company is indemnified from any liability between the company and the customer once an agreement has been signed.
· The terms outlined in this document between the company and the customers are governed by English law.
· If you decide not to engage our services after initially signing a contract. You may cancel this agreement within the first seven days of signing by providing written notice or confirmation by email.
· Both parties may terminate the agreement without any refund by giving 30 days’ notice in writing or by email.
